Ashley® A-List Text Message Program Terms

Ashley Global Retail, LLC and its affiliates offer customers marketing messages about events, new products, and other offers by SMS message (the "Service"). By participating in the Service, you are agreeing to these Text Message Program Terms.

Signing Up and Opting-In to the Service. 
Enrollment in the Service requires you to provide your mobile phone number and to agree to these terms and conditions. You may not enroll if you are under 18 years old (except in Alabama and Nebraska, 19 years old). Before the Service will start, you will need to verify the mobile phone number you provided by responding to a text message to your mobile phone that affirms your choice to opt-in to this Service and your agreement to these Text Message Program Terms. We reserve the right to stop offering the Service at any time with or without notice.

By opting into the Service, you:

  • Authorize us to use autodialer or non-autodialer technology to send text messages to the mobile phone number associated with your opt-in (i.e., the number listed on the opt-in form or, if none, the number from which you send the opt-in, or, if none, the number on file for the account associated with your opt-in).
  • Acknowledge that you do not have to agree to receive messages as a condition of purchase.
  • Confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt in.
  • Consent to the use of an electronic record to document your opt-in.
  • Agree that our Privacy Policy governs our treatment of any information, including personal information, that you submit to us.

THESE TEXT MESSAGE PROGRAM TERMS INCLUDE A BINDING ARBITRATION AGREEMENT, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER THAT AFFECT YOUR RIGHTS. PLEASE CAREFULLY REVIEW THE ARBITRATION AND CLASS WAIVER SECTION BELOW.

Messages You May Receive. 
Once you affirm your choice to opt in to the Service, your message frequency may vary. You may receive an alert when you are welcomed into the Service and when we send you marketing or promotions.

Message and data rates may apply. 
Please consult your service agreement with your wireless carrier or contact your wireless carrier to determine your phone's pricing plan and the charges for sending and receiving text messages. You acknowledge that you are responsible for any message, data or other charges incurred (usage, subscription, etc.) as a result of using the Service.

The text-in number or short code may not be supported on all U.S. wireless carriers. The Service may not be available on all wireless carriers. We may add or remove any wireless carrier from the Service at any time without notice. Neither we nor any mobile carriers are responsible for any undue delays, failure of delivery, or errors in messages.

To Stop the Service

To stop receiving text messages from us via the Service, text the word STOP to 274539 any time or reply STOP to any of the text messages you have received from us. You acknowledge that the text message platform may not recognize and respond to unsubscribe requests that do not include the STOP keyword command and agree that neither we nor our service providers will have any liability for failing to honor such requests. These Text Message Program Terms still will apply if you withdraw the consent mentioned above or opt out of the Service.

Arbitration and Class Waiver. Except for small claims actions, which may be brought by either you or us, you agree to binding individual arbitration before the American Arbitration Association, which shall be governed by the Federal Arbitration Act. You agree that you are giving up your right to a jury trial, and that any dispute resolution proceedings will be conducted on an individual basis and not as a class or representative basis. 

Proceedings may not be combined without the consent of all parties. If your arbitration is part of a group of Related Cases (as defined in our dispute resolution process ("DRP"), which can be found at www.ashleyfurniture.com/drp), you agree to certain batch arbitration procedures. You acknowledge that you had the ability to review the DRP, and that you are bound thereby even if you have not read it.

Data Privacy. 
Data obtained from you in connection with this Service may include your cell phone number, your carrier's name, and the date, time and content of your messages and other information that you may provide. We may use this information to contact you and to provide the Service to you request from us, and to otherwise operate, develop and improve the Service. Please read our Privacy Policy for more information. Your wireless carrier and other service providers may also collect data about your SMS usage, and their practices are governed by their own policies. We will only use information you provide to the Service to transmit your text message, as permitted by our Privacy Policy, or as otherwise described in these Text Message Program Terms. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property.
